Google Earth游记：巴格达

这篇帖子，实际上是上次发第一篇《Google游记：昆明》时一并写好了的。一晃两个多月过去了，一直没发，最近不太有时间更新Blog，就把它先发出来吧。

根据维基，巴格达市建于公元762年，乃中世纪世界三大名城之一。巴格达（بغداد‎或Baghdād）是伊拉克首都，也是巴格达省的首府。在历史上，巴格达曾是伊斯兰文明的中心。底格里斯河流经巴格达市中心。巴格达这个名称来自于波斯语，含义为“神（bagh）的赠赐（dād）”。巴格达绝对是个大城市，我大致比较了一下，它的市区直径大约等于上海从虹桥机场到浦东机场那么大。

摘要：著作权是以法律关系的客体(作品)为逻辑起点发展出的制度体系,而邻接权的逻辑起点则在于法律关系的主体(作品传播者)。这一差异是解决著作权和邻接权关系的重要理论工具。基于此,本文对两个实践中的问题进行了梳理,明确提出:原作品的著作权人不可能成为相应的邻接权主体,而所谓"信息网络传播者权"也没有存在的合理性。

司法裁断与行政执法的困顿与解决

　　前两天在《检察日报》上，把香港有关淫亵与不雅物品的制度大致说明了一下（点这里看）（另一个更详细的版本）。大体意思是：与内地相比，香港的制度相对成熟，以司法为核心，通过程序正义达到实质公正的思路值得借鉴。这些都是就制度解释制度。

　　之所以就制度解释制度，是因为篇幅有限。那么短的篇幅里很难说清，弄得不好，还可能让人会错意，以为是在说香港法律不好——几年来，我渐渐相信有良法与恶法之分（至少在相对意义上），比如香港的淫亵与不雅管制法律，就比内地的成熟良好。

　　但是，即使是这种相对良好的法制，在遇到极端情形时，也还是会遭遇困顿。香港法律对淫亵与不雅品的管制在大的原则上没问题，但在具体的地方，仍值得反思。

　　根据香港的法律，一件东西是否属于淫亵或者不雅，需要经过司法裁断作出最终定性。同时，根据法律的规定，如果发布者自己不确定自己发布的信息是否淫秽，应该事先主动把要发布的东西送到审裁处（这是个tribunal，是司法机构）评价。而如果你没有提交审裁就发布了，此后如果司法裁断为淫亵，那么你照样要承担相关刑事责任。如果审裁后，被评定为二级或三级，不是说就完全禁止传播，而是对传播的范围和方式有了限制（注意，传播和公开传播有区别）。这种制度设计，对发布信息的人来讲，是合理的——无论你的价值观与大众多么地不同，你至少应该了解大众的一般价值观，因为“发布”的对象是公众，所以如果一般价值观都认为这个照片很黄很暴力，你还是发布出去，那就不是一句很傻很天真能免责的了。

Google的春运交通图：让我们都成为聚沙成塔的小蚂蚁

　　Google在国内的地图服务是ditu.google.cn，在国外的是maps.google.com，两者之间的差距不可以道里计，前者地图的功能和更新程度，在许多方面还不如百度的地图（有趣的是，百度这个“国货”地图的域名反而是map.baidu.com）。不过，这回Google对春运雪灾的反应上，则是非常地快。“春运交通图（点击进入）”应时而生，非常值得称赞。

　　被堵在半路上，是出行者最怕的事，这个我有过深切的体会。这张“春运交通图”理论上能提供各地最新、最详细的路况信息——为什么这么说？因为这张图除了集合了Google的页面搜索技术，从网上找各种相关天气、交通新闻外，还接受你我的报料——任何人都可以向chunyun.china@gmail.com发送最新的天气和交通情况——这等于是把各地的短波交通台集中到了网上。我一下子想起自己以前编的一个关于未来的科幻故事，如果在技术上解决得好的话，这种聚沙成塔的信息传播模式一旦运作顺畅，估计很快就可以代替各种传统的门户网站。

　　总而言之，这次得谢谢Google。花两分钟时间，把你身边的天气情况或者了解到的最新信息发过去吧，至少比看八卦图片有意义，大过年的，出门在外的人不容易，也许你的一个路况信息，就防止了一次可怕的车祸呢。另外，就着这个帖子再推荐一下爱卡车友会社区，上面的各地分会里，有大量最新的路况帖子和行车攻略，如果要开车回家的朋友，可以再到那看一看。
