论著作权法中的孤儿作品问题

豆按:本文动笔于2006年,初稿完成于2008年并纳入本人论文《多元视角下的著作权法公共领域问题研究》,后经修改在2010年知识产权“南湖论坛”上作为主题发言。鉴于中国国家版权局《著作权法修正案》(草案)中提及孤儿作品问题,但真正深入的论述仍然十分罕见,特再次修改并全文发出,以便研究者和立法者予以批评和参考。
 

[摘要] “孤儿作品”是指因难以找到权利人,利用人无法取得授权的作品。美国2006至2008年已有多项法案提交国会讨论。加拿大、日本、韩国等各国立法中也有解决类似问题的尝试。此外,2009年谷歌公司与两个美国著作权组织向法院提交的“谷歌图书和解协议”中,也尝试以私人合同的方式建立一种解决孤儿作品问题的规则。孤儿作品现象在中国同样存在且可能更为普遍,现行中国著作权制度中,有看上去涉及到孤儿作品,但实际上使孤儿作品问题更加复杂化的制度。它们不但没有为该问题的解决提供足够的制度资源,而且还存在着不合理的规则。经过对国际条约和著作权法原理的通盘考虑,本文提出选择孤儿作品问题的治理方案时应考虑四个方面的因素,以它们为评价标准,才可批评和借鉴各种解决孤儿作品问题的模式和思路。在综合各种模式的优长后,本文结合中国法律史体系的特点提出一套多模式并用的、适合于中国的孤儿作品法律治理方案。
